Terms of Service

These terms govern your use of Helmia, an AI-powered platform for creating short-form video advertisements. By creating an account or using the service, you agree to them.
01Who we are
Helmia is an independent product operated from Barcelona, Spain (“Helmia”, “we”, “us”). You can reach us at hello@helmia.ai.
02The service
Helmia lets you direct and generate multi-scene video advertisements using artificial intelligence. You describe what you want; the platform generates images, video clips, voiceover and assembled videos through a combination of our own software and third-party AI providers. Generative AI is probabilistic by nature. We do not guarantee that any specific generation will match your expectations, be free of artifacts, or be suitable for a particular purpose. Regenerating a scene consumes credits like any other generation.
03Your account
You must be at least 18 years old to use Helmia. You are responsible for keeping your credentials secure and for all activity under your account. We may suspend or terminate accounts that violate these terms.
04Credits and payment
- Helmia operates on a prepaid credit system. Credits are purchased through our payment processor, Stripe. We never see or store your full card details.
- Credits are consumed when you trigger generations (images, video clips, voiceover, lipsync, assembly). The cost of each operation is shown in the product.
- Credits are not redeemable for cash and are non-transferable between accounts.
- EU right of withdrawal: by purchasing credits and beginning to use them, you expressly consent to the immediate supply of digital content and acknowledge that you lose your 14-day right of withdrawal for credits already consumed. Unused credits within the 14-day window may be refunded on request.
- We may change credit pricing at any time. Changes never affect credits you have already purchased.
05Your content
You may upload images (for example, reference photos of characters or products) and provide text prompts. You retain all rights to the content you upload. You grant us a limited license to store and process it solely to operate the service, including passing it to the third-party AI providers listed in our Privacy Policy as required to fulfil your generation requests. We do not use your uploaded content or your generated videos to train AI models.
06Faces, likeness and consent
This is the rule that matters most on Helmia.If you upload a photo of a real, identifiable person to use as a character reference, you confirm that you have that person’s documented consent and the rights to use their likeness in AI-generated advertising. If you do not have those rights, use invented, non-recognizable faces instead.
You may not use Helmia to generate content depicting real public figures, celebrities, or any identifiable person without their consent. We may remove content and suspend accounts that violate this rule, without refund of consumed credits.
07Generated content and ownership
Subject to these terms and to the terms of the underlying AI providers, we assign to you all rights we may hold in the videos, images and audio you generate with Helmia, and you may use them commercially. Two honest caveats:
- The legal status of AI-generated content varies by jurisdiction, and in some places purely AI-generated works may not qualify for copyright protection at all.
- Because generative models can produce similar outputs for similar prompts, we cannot guarantee that your generated content is unique or that similar content will not be generated for other users.
08Acceptable use
You may not use Helmia to create content that:
- Depicts real people without consent (see section 06), including deepfakes of any kind;
- Involves minors in any form;
- Is deceptive advertising, including fake testimonials presented as real people making claims they never made, or ads that violate consumer-protection or advertising-standards law in the markets where you run them;
- Infringes third-party intellectual property, including brands, characters or copyrighted works you do not own;
- Is unlawful, defamatory, hateful, or promotes violence.
You are the advertiser. You are solely responsible for ensuring the ads you create comply with the advertising rules of the platforms where you publish them (TikTok, Meta, YouTube, etc.) and with applicable law, including any obligation to disclose that content is AI-generated where required.
09Third-party providers
Helmia orchestrates external AI and infrastructure providers (image and video generation, avatar lipsync, voice synthesis, language models, hosting and storage). These providers may experience outages, degrade quality, change their models, or discontinue features, all outside our control. We will always do our best to route around problems, but we cannot guarantee uninterrupted availability of any specific model or capability.
10Disclaimers and liability
Helmia is provided “as is” and “as available”. To the maximum extent permitted by law, our total liability for any claim arising from the service is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited under applicable law, including in respect of consumers’ statutory rights.
11Termination
You can stop using Helmia and delete your account at any time. We may suspend or terminate your access for breach of these terms. On termination for breach, consumed credits are not refunded; unused credits will be handled reasonably and in accordance with consumer law.
12Changes to these terms
We may update these terms as the product evolves. If a change is material, we will notify you by email or in-product before it takes effect. Continued use after the effective date constitutes acceptance.
13Governing law
These terms are governed by Spanish law. Any dispute will be submitted to the courts of Barcelona, Spain, without prejudice to any mandatory consumer jurisdiction rules that entitle you to litigate where you reside.
